Terms Of Use
Introduction
These Terms of Use ("Terms") apply to the website operated by Eldan Transportation Ltd., Company No. 510454333, located at Yehezkel Kaufman 6 Street, Tel Aviv, and/or its subsidiaries and/or affiliated companies (collectively: "Eldan") at the address: https://www.eldan.co.il/) ("the Website"). Any use of the Website, including any transaction, order, etc., made through the Website, and including any information provided directly or indirectly on the Website, will be governed by these Terms and Eldan's privacy policy.
All users of the Website ("User(s)") must read and agree to the Terms before using the Website. By confirming that they have read the Terms, the User agrees to be bound by these Terms, which will serve as the User's absolute, final, and irrevocable confirmation that they have read the Terms, understood their content, and agreed to their terms.
Without derogating from the above, entering, browsing, or using the Website in any manner and for any purpose will be considered as absolute and irrevocable acceptance of the Terms. If the User does not agree to the Terms, in whole or in part, they are prohibited from visiting or using the Website.
Violation of the terms of use may lead to the blocking of the user's access to the site, and may also lead to legal proceedings and/or actions taken against the user by Eldan and/or its representatives and/or any competent authority and/or third parties.
Eldan reserves the right to update and/or change and/or correct and/or add and/or remove parts of these terms of use from time to time, at its sole discretion and without prior notice. Any changes made to the terms of use will automatically apply to all users, whether they have expressed their consent or not, and it is the sole responsibility of the user to review the terms of use from time to time to stay updated on any updates, changes, and corrections to the terms of use.
Eldan is the owner or has the right to use all intellectual property rights, whether registered or unregistered, including all copyrights, patents (including pending patents), trademarks, logos, website designs, in connection with all information and/or content and/or materials published on the site, including text, design, databases, software, code, images, audio clips, video, questionnaires, and statistics (hereinafter: "the materials"). Users are prohibited from copying, modifying, reproducing, publishing, transmitting, republishing, correcting, uploading, publicly displaying, sending, selling, marketing, or otherwise transferring any of the materials, in whole or in part, without prior written permission from Eldan.
Vehicles Offered on the Website
Eldan offers a wide range of vehicles for rental or leasing in Israel. Details about the vehicles available for rental in Israel through the website can be found on the "Car Rentals" page under the "Car Rental in Israel" tab. If the user is interested in renting vehicles outside of Israel, they should click on the "Car Rental Abroad" tab on the Car Rentals page, which will redirect them to the rentalcars.com website operated and managed by them.
Details about vehicles intended for private leasing transactions through the website can be found under the "Private Leasing" tab. Additionally, Eldan offers a variety of vehicles for purchase, including used vehicles from the first hand and new vehicles ("0 km") from the first hand, with different payment plans.
Eldan reserves the right, subject to these terms of use, to change from time to time the composition of the vehicles, their prices, and the terms of their purchase and/or rental and/or leasing (including special offers and promotions), at its sole discretion and without prior notice.
All images appearing on the website are for illustration purposes only, and there may be changes and/or inaccuracies and/or discrepancies between the vehicle images displayed on the website and the vehicles actually rented or purchased. Additionally, any description regarding the suitability of the vehicles for a certain number of passengers or for storing a certain number of suitcases is based on average measurements and should be checked on a case-by-case basis. Therefore, it is clarified that the images do not constitute a representation or commitment by Eldan regarding the rental or sale of vehicles. Without derogating from the specific terms of promotions published by Eldan from time to time, the content and information appearing on the website shall not be construed as an offer as defined in the Contracts Law (General Part), 1973 and/or as a commitment by Eldan towards any specific user regarding the terms of any transaction, its availability, or the possibility of its realization.
Eldan is not responsible or liable for any malfunctions or errors that may appear on the website, including inaccuracies regarding the description of the vehicles and/or their prices. The use of this website and reliance on the information presented on it is therefore at the user's sole responsibility.
Vehicle Purchase
At Eldan, you can purchase new vehicles ("0 km") from the first hand and used vehicles from the first hand. In this section of the website, we provide users, among other things, with information regarding vehicles offered for sale, assistance in establishing contact between the user and Eldan, and allow users to reserve vehicles they are interested in purchasing.
New Vehicles ("0 km")
The website displays a variety of models of new vehicles ("0 km") along with various financing plans relevant to these vehicles. The website presents (including through links) data about the vehicles and specifications taken from the importers' websites. These data and specifications are provided as general information for the user's convenience only and may be updated from time to time. Eldan recommends that the user directly visit the various importers' websites to view the most up-to-date and complete specifications of the relevant vehicle.
Any reference to the "price list" concerning new vehicles refers to the importer's price list, including VAT (excluding licensing fees). The prices displayed on the website may change from time to time according to changes in the car market, including the importer's price list.
It is clarified that the completion of the sale of the vehicles offered on the website is subject to the availability of the relevant vehicle in Eldan's stock or the importer's stock at that time. If the vehicle the user is interested in is not in Eldan's stock or the importer's stock as mentioned, the user can contact Eldan to order the vehicle through Eldan, and in this case, Eldan will update the user upon the vehicle's arrival in the country to complete the vehicle purchase process.
Used Vehicles
The website displays price offers for the purchase of used vehicles from the first hand. It is clarified that any reference to the "price list" refers to the Levi Yitzhak price list (without reductions) considering the date of the vehicle's registration and considering defined additions to the vehicle model (and not to the specific vehicle). It is hereby clarified that the prices displayed on the website may change from time to time according to changes in the car market, including the Levi Yitzhak price list. It is also clarified that the completion of the sale of the vehicles offered on the website is subject to the availability of the relevant vehicle in Eldan's stock at that time.
If, during browsing the website, the user is able to view an inspection report regarding a specific vehicle, it is hereby clarified that the inspection report is prepared by an inspection institute that is a third party not affiliated with Eldan, and this inspection was conducted under the sole responsibility of that third party. Eldan recommends that users conduct an independent inspection of the vehicles at an institute of their choice.
Vehicle Reservation
If a user is interested in one of the vehicles offered for sale on the website, the user can reserve the vehicle at the offered price, subject to the payment of the reservation fee specified during the vehicle reservation process. During the reservation process, the user will need to provide their full name, phone number, email address, choose the desired payment plan, and ensure that the details are correctly filled in. Upon reserving the vehicle, an Eldan representative will contact the user within one business day to complete the sale transaction, and Eldan will reserve the ordered vehicle for the user at the offered price for 5 business days (hereinafter: "the vehicle reservation period"). If the sale transaction is not completed by the end of the vehicle reservation period, the transaction will be automatically canceled, and Eldan will refund the user the full reservation fee within 14 days from the date of cancellation. It is clarified that the completion of the vehicle purchase transaction is subject, among other things, to signing a sales agreement tailored to the vehicle purchase (hereinafter: "the sales agreement") and paying the full consideration for the vehicle by the delivery date, during which time Eldan recommends that users independently inspect the vehicle. It is clarified that merely leaving details on the website does not obligate Eldan or the user, except as part of the vehicle reservation process described above. It is hereby clarified that the vehicle purchase is not actually done on the website, and until the agreement is signed, the user can change their mind at any stage and cancel the vehicle purchase.
Eldan reserves the right not to contact the user and/or refuse to sell the user a vehicle for any reason at its sole discretion, and in such circumstances, Eldan will refund the user the reservation fee paid by them.
"Not Satisfied? Return It" Benefit
Users who have purchased a vehicle from Eldan and have received the vehicle are entitled to cancel the transaction and return the vehicle within 5 business days, subject to meeting the eligibility conditions of the benefit and the redemption conditions specified below. It is hereby clarified that if a user who purchased a vehicle does not provide a cancellation notice within 5 business days as mentioned above, Eldan will transfer the ownership of the vehicle to the user's name independently, in accordance with the provisions of the sales agreement and the law. The eligibility conditions for this benefit are as follows:
• The user has signed the sales agreement lawfully, to which the "Not Satisfied? Return It" redemption conditions appendix is attached and tailored to their details.
• The eligibility for this benefit does not apply to the following vehicles:
• A vehicle purchased as part of a "trade-in" transaction; or
• A vehicle for which the full consideration, as stated in the sales agreement, exceeds 150,000 NIS (including VAT); or
• A vehicle for which the consideration was financed by a financing body other than Fama Vehicle Financing Ltd. or Direct Financing from the Direct Group Ltd.; or
• An electric vehicle; or
• If it is a new 0 km vehicle, at the time of signing the sales agreement, the relevant vehicle is not in the company's stock; or
• Mitsubishi Attrage vehicles; or
• If it is a new 0 km vehicle, this specific model has been excluded from the benefit by Eldan at its sole discretion. To check if a specific vehicle has been excluded from the benefit, you can contact the company at 03-5577021.
• The redemption of the benefit is subject to the user's compliance with all the redemption conditions attached to the sales agreement, including, among other things, that no ownership transfer has been made on the vehicle, the vehicle is free of any debt, lien, etc., no changes or installations have been made to the vehicle, the vehicle is kept in good condition and has not suffered any damages, including reasonable wear and tear and tire damage, the vehicle has not traveled more than 200 km on average per day, and the user will be required to pay usage fees ranging from 100-150 NIS per day (including VAT), all as detailed in the full redemption conditions that will be signed by the user as part of the vehicle purchase.
Vehicle Financing
Eldan offers users various financing options through different financing entities. It is clarified that the financing and its terms, including the interest rate and loan period, are subject to the absolute discretion of the relevant financing entity (hereinafter: "the financing entity") and are subject to the signing of financing documents to its satisfaction. It is clarified that the financing entity is a third party not affiliated with Eldan, and Eldan is not a party to the financing transaction conducted directly between the user and the financing entity. Therefore, Eldan will not bear any responsibility towards the user regarding the financing transaction documents. It is clarified that the presentation of the financing terms mentioned does not constitute an offer to provide credit to the user or an agreement to provide credit by the financing entity.
Failure to repay the loan or credit may result in late interest charges and enforcement proceedings.
The financing entity may change its underwriting policy and the terms of credit provision, including interest rates and fees, at any time and without prior notice.
The loans will be provided with a maximum repayment period of 60 months, and in some cases, they may be subject to a balloon payment at the end of the loan, which will be a certain percentage of the user's debt to the financing company.
It is explicitly clarified that any instance on the website where it is stated that the cost is "starting from x NIS per month" refers to monthly payments for an estimated repayment of a loan provided by a third party, which includes a down payment and up to 60 fixed monthly payments plus a fixed annual interest rate linked to the consumer price index. The provision of the loan and its terms, including the amount of the monthly payments and the interest rate, are subject to the approval of the financing entity and at its sole and absolute discretion, and the signing of financing documents to its satisfaction, which Eldan is not a party to.
It is hereby clarified that if a loan is provided to the user by a financing entity, failure to repay the loan or credit may result in late interest charges and enforcement proceedings.
Financing Calculator
The financing calculator on the website is only an estimated simulation of providing a loan and is intended for illustration purposes only. The calculations do not obligate the financing entity and/or Eldan to provide the loan, if it is provided to the user, or to the terms under which it is provided.
The calculation results presented refer to financing at a fixed annual nominal interest rate that will be shown to the user on the "Financing Options" page, linked to the consumer price index, and do not take into account possible changes in interest rates or reference to additional payments, including licensing fees, late interest, and/or additional fees that will be charged to the user according to the financing entity's procedures and subject to legal provisions. Therefore, the actual cost rate of the credit will change according to the loan data. The loans will be provided with a maximum repayment period of 60 months, and in some cases, they may be subject to a balloon payment at the end of the loan, which will be a certain percentage of the user's debt to the financing entity.
The use of the financing calculator does not constitute an offer to provide credit to the user or an agreement to provide credit by the financing entity.
The financing entity may change its underwriting policy and the terms of credit provision, including interest rates and fees, at any time and without prior notice to users of the financing calculator.
The data should not be considered as a recommendation, advice, or opinion regarding the feasibility of purchasing a vehicle through financing and/or any of the plans presented in the financing calculator.
The use of the financing calculator constitutes the user's acknowledgment and agreement to the above terms.
Eldan does not commit to providing financing, and the provision of the loan and its terms, including the interest rate, are subject to the approval of the financing entity and at its sole and absolute discretion, and the signing of financing documents to its satisfaction.
Eldan will not bear any responsibility regarding the use of the financing calculator and reliance on it.
**Failure to repay the loan or credit may result in late interest charges and enforcement
Rentals
To make a reservation, the user must follow all the instructions detailed on the website under the "Car Rental" tab. If the user is interested in renting a car in Israel, they should click on the appropriate tab. In this context, the user will need to fill in complete details about the requested reservation, including vehicle pick-up and drop-off locations, dates and times, vehicle group, upgrades, additions, and provide personal information required for the reservation from time to time ("reservation details"). It is hereby clarified that the user does not choose a specific car model but a vehicle group that includes certain vehicle models, as indicated in the reservation process.
To ensure the reservation is fully processed, it must be entered accurately and correctly, including completing all fields marked as mandatory with an asterisk or otherwise in the reservation process. A reservation that includes missing or incorrect reservation details, or that was not entered and/or processed correctly, will not obligate Eldan (even if the defect is not the user's fault and/or due to a technical malfunction on the website).
Upon making the reservation, an electronic notification will be sent to the user to the email address provided in the reservation details, including one of the following:
(1) A reservation voucher confirming the reservation and its details ("reservation confirmation")
(2) A notification stating that the reservation is still pending and subject to further approval by Eldan.
Upon receiving the reservation confirmation by the user, Eldan will be obligated to provide the user with a vehicle from the relevant vehicle group. However, Eldan does not commit to providing the user with a specific vehicle from the mentioned vehicle group, and Eldan reserves the right to substitute between similar vehicle models to those ordered. The vehicle images displayed on the website for each vehicle group are for illustration purposes only.
It is hereby clarified that a reservation not confirmed by receiving a reservation confirmation will not obligate Eldan in any way.
All rentals are and will be subject to the rental terms ("rental terms") and the conditions set forth in Eldan's standard agreement, which will be signed by the user at the time of vehicle pick-up (including the rental conditions attached to it) (hereinafter "the full rental conditions", and together with the rental terms: "the standard agreement").

Add-ons
The website offers users a variety of add-ons for car rentals, including but not limited to: baby seats (for ages 1-3, maximum weight 18 kg), boosters (for ages 4-8, minimum weight 18 kg), additional driver, collision damage waiver, window coverage, iPad, etc. ("the add-ons"). Payment for the add-ons will be made on the website or at the rental counter or directly to the third party providing the relevant service (as specified in the reservation process). It is clarified that add-ons not provided directly by Eldan are subject to the terms of use of the relevant third party providing these add-ons, and Eldan is not responsible for them. In case of damage and/or loss of an add-on, Eldan will charge compensation for the damage or loss according to the provisions of the standard agreement (or the terms of use of the relevant third party).
Damage Coverage
The website offers users damage coverage options as detailed in the full rental conditions. For more information, the user should refer to the full rental conditions.
Payment and Collection
The estimated cost of renting the vehicle is the cost indicated on the website at the time of booking, which does not constitute the final cost to the user, but only an estimated cost based on the rental data at the time of booking. The final cost is subject to any changes, corrections, or additions to the rental data, including but not limited to shortening or extending the rental period, changing the pick-up/drop-off location, purchasing add-ons, etc.
During the booking process, the user will be given the option to see the estimated cost of renting the relevant vehicle in different currencies. The display of the estimated cost in different currencies is provided for the user's convenience only, with the conversion being made according to the latest exchange rate published by the Bank of Israel and known at that time. Notwithstanding the above, it is hereby clarified that the actual payment will be made only in the currency automatically selected by the system according to the user's geographical location. For example, if the user makes the booking in Israel, the payment for the booking will be made in New Israeli Shekels only.
As part of the reservation process, the renter will be given several payment options: full or partial payment in advance through the website or payment at the Eldan counter when renting the vehicle. In certain cases, at Eldan's sole discretion, it will not be possible to pay in full for the rental at the time of vehicle pick-up, and the renter will be required to pay for the entire reservation or part of it at the time of booking. It should be noted that the estimated rental cost may vary depending on the payment method chosen by the renter. Any payment made in connection with the above will only be possible using a valid credit card that can be processed by one of the credit card companies operating in Israel and is subject to the credit card company's approval. Eldan will not accept other payment methods, including cash.
The renter must collect the vehicle at the scheduled pick-up time and no later than two hours from that time. Otherwise, Eldan does not commit to holding the reserved vehicle for the renter. It is clarified that during the summer months, Israeli holidays, and the Christmas period, the renter must collect the vehicle no later than one hour from the scheduled pick-up time. Otherwise, Eldan does not commit to holding the reserved vehicle for the renter.
At the time of vehicle pick-up, the user must present a valid driver's license, ID card, and a valid credit card in their name, which must be the same credit card used to make the reservation. Subject to the credit card company's approval, this credit card will serve as security for any payment the user owes to Eldan according to the standard agreement, up to the amount provided to the renter at the time of rental, which reflects the rental cost plus 3,500 NIS (hereinafter: "the security"), and this security will be renewed from time to time. The user must ensure in advance that the credit card has sufficient credit limit to provide the security. It is hereby clarified that to complete the reservation, the credit card details used to make the reservation must be identical to those of the driver who will drive the vehicle.
It is clarified that the minimum rental period is 24 hours. Any user who rents a vehicle for a period shorter than 24 hours will be charged for a full 24-hour period. Additionally, Eldan reserves the right, at its sole discretion, to determine that a specific rental is subject to a longer minimum rental period.
It is hereby clarified that the rental payments do not cover various charges related to the rental as specified in the standard agreement (such as deductible fees (if applicable), parking and traffic fines, toll road or fast lane usage, fuel, excess mileage fees, service/handling fees, etc.).
The prices are as displayed at the time of booking and, unless otherwise stated, include VAT. Additional information can be found in the rental terms. Any payment not made by the user in full and/or on time will bear linkage differentials and late interest at the rate applicable from time to time on debit balance overdrafts in Israeli Shekels at Bank Leumi Le-Israel Ltd. for unauthorized overdrafts, calculated from the charge date until the actual payment date. Additionally, the user will be charged by Eldan for collection expenses, including legal expenses and attorney fees, as incurred by Eldan.
Cancellation and Update of Reservations
The user may cancel the reservation as follows: (a) by completing the "Reservation Cancellation Form"; (b) by sending an email to cancelorder@eldan.co.il; (c) by calling *3003; or (d) by sending a fax to 077-7613889. Any cancellation notice must be made within 14 days of making the reservation and at least 2 business days before the vehicle pick-up date. Eldan will send the user a confirmation of the reservation cancellation within 2 business days after receiving the user's cancellation notice. In the case of cancellation within the aforementioned time frame, Eldan may charge the user a cancellation fee of 5% of the rental cost or 100 NIS (whichever is lower) using the credit card provided by the user for the reservation. Notwithstanding the above, Eldan may charge the user a cancellation fee of up to 150 NIS in the following cases: (a) if the cancellation is made outside the specified time frames; or (b) if the user does not show up to collect the vehicle at the scheduled pick-up time ("No Show"); or (c) if the user arrives to collect the vehicle but does not meet the prerequisites required to rent the vehicle according to these terms or the full rental conditions (for example, if the user does not have sufficient credit limit or does not present a valid driver's license). The cancellation fee will be charged for each vehicle reserved, subject to the provisions of any law. Notwithstanding the above, in the case of cancellation of a reservation for a mini-compact, medium, or family vehicle, the user will not be charged a handling fee provided that the cancellation notice is given to Eldan at least one business day before the scheduled vehicle pick-up date. In any other case, the user will be charged a cancellation fee as mentioned above.
*A user who wishes to update their rental details (including rental dates, vehicle type, add-ons, pick-up/drop-off location, damage coverage, etc.) may do so by completing the "Reservation Update Form" or by contacting Eldan by phone at 3003. An Eldan representative will contact the user within 2 business days after receiving the user's request to confirm whether the update is agreed upon by Eldan and if this update affects the rental cost for any reason. If Eldan does not approve the request to update the reservation terms for any reason, the original reservation terms will remain in full force. If the user wishes to cancel their reservation (due to the non-approval of the reservation update request or because the user does not agree with the updated rental cost), the user may do so in accordance with the cancellation policy detailed above, and Eldan may charge the user a cancellation fee according to the cancellation timing mentioned above. In any case, for the avoidance of doubt, the reservation update will only take effect after receiving an updated reservation confirmation from Eldan. A "Reservation Update Form" that includes missing or incorrect reservation details or that was not entered and/or processed correctly will not obligate Eldan (even if the error is not the user's fault and/or due to a technical malfunction on the website).
It is hereby clarified that any update to the reservation details (including dates, vehicle type, pick-up/drop-off location, add-ons, damage coverage, etc.) may change the estimated rental cost, and in such circumstances, Eldan will not be obligated to the pricing that appeared during the initial reservation process, including the prices of add-ons and damage coverage.
If, after receiving a reservation confirmation, for any reason, the vehicle and/or any add-on included in the reservation is not available, Eldan will offer the user an alternative vehicle and/or add-on equivalent to those ordered by the user (if available). If the user chooses not to rent the alternative vehicle and/or add-on, the reservation will be canceled, and Eldan will refund the user the full amount paid without cancellation fees. It is clarified that in this case, the user's sole remedy will be the refund of the payment made, and the user will not be entitled to and hereby waives any claims or demands for losses, costs, damages, etc., including direct and indirect damages.
Without derogating from the above, Eldan reserves the right not to honor and/or cancel reservations at any time and at its sole discretion, including but not limited to the following cases: (1) the credit card company did not approve the relevant charges and/or the credit card used for the reservation is blocked or restricted in any way; (2) the user provided false or fraudulent information, or the reservation was made by a third party impersonating the user; (3) the user committed or attempted to commit an illegal act through the website, or the user allows, incites, assists, or encourages the commission of an illegal act; (4) the user performed an act or omission that causes or may cause damage to Eldan or third parties; (5) the user violated the terms of use, rental terms, the standard agreement, and/or any other agreement with Eldan or its representatives; (6) it turns out that a clerical or technical error was made in the reservation components regarding the vehicle (including its type), add-ons, damage coverage, prices, payment terms, etc.; (7) in the event of a server or system crash operating the website; and/or (8) in the event of force majeure, such as acts of war, terrorism, hostility, or other circumstances beyond Eldan's control, which prevent or may reasonably prevent, at its discretion, the execution and/or honoring of the reservation.
VIP Gold Club
A user who has rented a vehicle from Eldan (from any vehicle group) at least seven times in a calendar year may receive VIP Gold customer status by registering for the club under the "VIP Gold Club" tab during the reservation process. VIP Gold customers enjoy the following benefits: • Quick and easy check-in through a separate counter at the airport. • Free vehicle upgrade (up to vehicle group F).
Eldan reserves the right to remove a user from the VIP Gold Club if the user no longer meets the club membership conditions as described above.
When making a reservation, the user must enter the required details during the reservation process to enjoy the benefits of being a VIP Gold Club member.
If a user encounters a problem with being recognized as a VIP Gold customer, they should contact Eldan at *3003.
Operational and Private Leasing
Operational Leasing
Eldan is one of the leading leasing companies in Israel and offers its customers full operational leasing services. If you are interested in these services, please leave your details under the "Operational Leasing" tab, and an Eldan representative will contact you.
Private Leasing
Additionally, Eldan offers its customers vehicles for lease under the private leasing method. In this transaction, the customer receives a new vehicle for their use for a defined period, along with additional services. In this transaction, the customer is required to pay a down payment and monthly lease payments for the duration of the lease period. The private leasing transaction includes an annual mileage quota defined in the leasing agreement, and any excess mileage will be charged according to the agreed-upon rate with Eldan in the leasing agreement, depending on the vehicle type.
It is clarified that the prices displayed on the website include VAT, and the monthly lease payments will be linked to the index and do not include the licensing fee.
Any reference to the "importer's price list" refers to the importer's price list, including VAT (excluding the licensing fee). The prices displayed on the website may change from time to time according to changes in the car market, including the importer's price list.

Personal Area - Role Holders
As part of the use of the website, Eldan allows defined role holders at its business customers (whether in operational leasing, business rental, or private leasing) to receive comprehensive information regarding the vehicles leased and rented by them for the purpose of efficiently and optimally managing their vehicle fleet. To do so, the role holder's details must be provided to Eldan so that their details can be set up in Eldan's systems. Once their details are set up, they will need to click on the designated button on the website and log in using their company registration number, VAT number, or ID number, mobile phone number, and perform verification via a text message received on the defined mobile phone. Once the role holder is set up in the system, they will be able to add additional users, but only if they require this authorization to perform their work.
The role holder is aware that as part of their use of the aforementioned personal area, they will view information regarding employees or other third parties using the vehicles as part of the leasing or rental transaction (hereinafter: "the users"), including their ID numbers, names, driver's license numbers and validity, including documents in which these details appear and/or any additional information as may be from time to time for the purpose of efficiency and providing optimal service. By using the aforementioned system, the role holder confirms that they have obtained all the necessary consents from those users to view, receive, and use their details, and neither they nor the users will have any claims that Eldan has violated the users' privacy rights as mentioned.
It is hereby clarified that Eldan's privacy policy provisions will fully apply to the information contained in the personal area.
It is the responsibility of the aforementioned role holder to ensure that only authorized personnel have access to the personal area and to revoke the permissions of any authorized personnel who leave their position in the organization or move to a role that does not require access to the information in the personal area. It is the responsibility of Eldan's customers to update Eldan if the role holder themselves leave their position or are replaced so that their authorization can be revoked.
The customer, the role holder, and any authorized personnel on their behalf will maintain absolute confidentiality regarding any information they may be exposed to in the aforementioned personal area, including information about Eldan, the agreement provisions, price quotes, work methods, etc. (hereinafter: "the information"). The customer, the role holder, and any authorized personnel on their behalf will not disclose the information to any third party, including by duplication, copying, photographing, and/or printing, except to their employees or service providers who need to know the information for the purpose of the engagement between the parties, provided they are bound by a confidentiality obligation no less stringent than the one stated above. These obligations will not apply to information that is in the public domain or required to be disclosed by law or was already known to the party exposed to the information as mentioned.
Without derogating from the above, Eldan makes every effort to ensure that the information appearing in the aforementioned personal area is up-to-date at all times. However, errors and inaccuracies may occur, and Eldan will not be responsible for any damage that may be caused to anyone in connection with this.
If, within the aforementioned personal area, the customer is transferred to third-party websites, including the Enterprise Group rental website, the use of these websites is done by the customer and their representatives at their sole responsibility, and Eldan is not a party to this.
Use of the Website and Materials
The user will use the website only in accordance with these terms of use and for lawful purposes only, and is prohibited from using the website in the following ways (collectively, "prohibited use"): (1) distribution, marketing, or promotion; (2) embedding links on the website without prior written approval from Eldan; (3) making reservations that include partially or fully incorrect details; (4) making changes to the website and the materials contained therein or attempting to do so; (5) disrupting and/or interfering with access to the website, including its components, servers, and network connections to the website, or attempting to interfere with other users' use of the website; (6) requesting or otherwise attempting to harvest, obtain, or store information; (7) concealing the source of the user's contact details; (8) using any computerized or automated mechanism to collect information from the website or make reservations through it; (9) contrary to any requirements, procedures, policies, or regulations of the networks connected to the website; (10) in any way that infringes, harms, or attempts to infringe or harm any right of Eldan or a third party; (11) any action that harms, humiliates, and/or defames others or damages their good name; (12) in any way that is contrary to any law or order of a competent authority or judicial order; and/or (13) use that violates the terms of use.
Eldan reserves the right, at its sole discretion, to prevent or restrict at any time the use of the website by a user who makes prohibited use of the website as described above, without prejudice to Eldan's right to exhaust any legal remedy available to it and without prior notice. Additionally, Eldan may take legal action to discover the identity of the user who makes prohibited use of the website and cooperate with any competent authority and/or judicial order in connection with the aforementioned.
Web Crawlers
The website is intended for private use only, and the use of automated software (also known as "search robots" or "web crawlers") to access the website and download large amounts of information is explicitly prohibited. The user acknowledges that this is a condition for accessing the website and undertakes not to use such technology to access the website. The use of such software constitutes grounds for Eldan to block the user's access to the website.
Additionally, the website may contain links to other websites. Eldan is not responsible for the content, products, services, or other details appearing on these websites or for the information retention practices or policies of those websites. The user's use of links to other websites, use of other websites, or services offered on those websites is at the user's sole responsibility.
Information Security
Eldan invests resources and takes various precautions to prevent hacking into the site's computers and/or its databases in order to prevent harm to users' privacy. However, Eldan cannot completely secure its computers and/or the site's databases from illegal access and unauthorized use of information. Therefore, by using the site, users agree that they will have no claim and/or lawsuit against Eldan and/or anyone on its behalf as a result of illegal access, if it occurs, to the site as described above and/or exposure and/or use of information as a result of the unauthorized access made to the site.
Limitation of Liability
Although Eldan makes reasonable commercial efforts to prepare and provide the services and materials presented on the site, Eldan or anyone on its behalf and/or entities related to it will not bear any responsibility or liability for any malfunction or inability to provide any service as a result of any event, condition, or circumstance beyond Eldan's reasonable control. The site, the services available through it, and the materials contained therein are offered and provided "as-is" and without any representation, commitment, and/or warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, compatibility, security, or accuracy, non-infringement, and the like, including with respect to time and performance.
Therefore, nothing stated on the site or in the terms of use shall be construed as a representation or commitment by Eldan regarding the reliability, correctness, timeliness, and accuracy concerning the information, content, items, links, and/or graphics of the site for any purpose. Although Eldan makes reasonable efforts to ensure that the information on the site is as up-to-date and accurate as possible, the site may include certain inaccuracies, omissions, or errors. Therefore, the use of the site and reliance on the information presented therein is at the sole responsibility of the user.
Eldan strives to maintain the proper functioning of the site, but it does not guarantee that the services provided through the site will not be interrupted and/or provided as usual and/or without interruptions, malfunctions, and cannot guarantee that the site will be immune to unauthorized access to Eldan's computers, damage or crash, including hardware, software, or communication lines and systems of Eldan or its suppliers in a way that will affect the normal operation of the site.
Eldan, its related entities, shareholders, directors, officers, employees, and/or anyone on their behalf from time to time will not bear any responsibility for any damage and/or loss of any kind, direct or indirect, incidental or special (including loss of profit), exemplary damages, punitive damages and/or any expense incurred by the user or anyone on their behalf or their property, whether directly or indirectly, in connection with and/or as a result of the use of the site, for breach of contract, tort (including negligence), product liability, including cases where an order and/or its cancellation and/or update of that order were not recorded and/or were not possible for any reason, all subject to any law.
Indemnification
By using the site, the user agrees to defend, indemnify, and hold harmless Eldan, its related entities, their shareholders, directors, officers, employees, and/or anyone on their behalf, from any damage, loss, liability, or expense incurred by them, directly or indirectly, including reasonable attorney's fees and court costs, due to the user's use of the site and/or in connection with or due to the user's breach of the terms of use and/or any claim, demand, and/or lawsuit brought against Eldan and/or anyone on its behalf, by the user or anyone on their behalf or by any third party in connection with and/or as a result of the user's use of the site.
Miscellaneous
The law applicable to these terms of use, including their interpretation, validity, and breach, is the law of the State of Israel, and the courts in the Tel Aviv-Jaffa district shall have exclusive local jurisdiction to hear any matter related to the terms of use. Eldan may refuse to accept cash payments according to its policies from time to time. Eldan's failure to exercise and/or enforce any provision or right under these terms of use shall not diminish Eldan's right to exercise and/or enforce such provision or right in the future and shall not be considered a waiver by Eldan of such provision or right. If Eldan decides to deviate from the terms of use, in cases determined at its sole discretion, this shall not create a binding precedent in any way and/or obligate it to act in the same or similar manner in any other case. Any waiver by Eldan regarding a breach of these terms of use shall not constitute a waiver regarding any other breach of the terms of use. If any provision is found to be unenforceable, that provision shall be reduced or deleted to the minimum extent necessary so that the remaining provisions shall remain in full force and effect. In these terms of use, the use of masculine or feminine language is for convenience only, and all provisions in these terms of use refer to both men and women equally. The headings in the terms of use are for convenience only and shall not be used for the interpretation of any provision of these terms of use.
In any case of conflict between the provisions of the terms of use and the provisions of the rental terms, the provisions of the rental terms shall prevail. In any case of conflict between the provisions of the terms of use and the provisions of the standard agreement, the provisions of the standard agreement shall prevail. In any case of conflict between the provisions of the terms of use and the provisions of the sales agreement, the provisions of the sales agreement shall prevail.
The amounts specified in the terms of use include VAT.
Any amount specified in any currency in the terms of use will be converted to the currency in which the payment is made, according to the last known representative rate published by the Bank of Israel and known at the time of the initial delivery of the vehicle. In any case of payment using a non-international card or an "American Express" card, this payment will be charged in US dollars or new shekels, according to the last known representative rate as mentioned, even if the prices and/or estimated rental costs are displayed in another currency.
The terms of use (including any document referred to in the terms of use) contain all the conditions related to the use of the site.
