Principal Terms of Rental

Below are the principal terms of rental governing the reservation and rental of a vehicle (the “Vehicle”) by a renter (the “Renter(s)”) from Eldan Transportation Ltd. (“Eldan”). It is hereby clarified that any and all rentals are and shall remain subject to the terms and conditions set out in Eldan’s standard car rental agreement, to be signed by the Renter(s) at the time of pick-up of the Vehicle (including the rental terms enclosed there to Detailed Terms Of Rental) (the “Full Rental Terms”, and together with the Full Rental Terms: the “Standard Agreement”).

Age

Drivers must be at least 18 years of age. The Vehicles offered for rental by Renters younger than the age of 24 (the “Young Driver”) shall be limited to the Vehicle groups A, C, D, DN, E, F, FN, F1 and G (the “Permitted Vehicle Groups”). Please see our vehicles for an explanation of the Permitted Vehicle Groups. If, notwithstanding the aforesaid, the Renter reserved a Vehicle which is not included in the Permitted Vehicle Groups then, subject to Eldan’s availability at such time, Eldan shall offer such Renter, to the extent possible, at the rental counter an alternative Vehicle which rental payment and other payments in relation to such rental shall not exceed the rental payment and other payments presented to such Renter during the reservation process. It is hereby clarified that Eldan may charge the Renter Young Driver Extra payment in respect of drivers younger than the age of 24 if so stipulated in the rental agreement.

Driver's License

Drivers must possess a driver's license in English which includes a photo of the driver, valid for at least one year from Renter’s entry to Israel. If the driver’s license is not written in English, the driver must additionally hold and provide Eldan an international license. The driver’s license must be suitable for the type of rented Vehicle. Only such persons holding a valid driver’s license for at least two years and which are present at the pick-up of the Vehicle whose details are set out in the Standard Agreement or in Eldan’s records are permitted to drive the Vehicle.

Coverage for Damages

Eldan offers the Renter with such coverage options as set out in Section 7 of the Full Rental Terms . For more information, please refer to the Full Rental Terms.

Reservation and Payment

Reservations may be made through Eldan’s website or by phone at 3003*. Reservations made on the website will be made following the instructions set out therein in accordance with the website’s terms of use at terms of use. Upon submission of the reservation through the website, Renter shall receive an email to the email address noted in the reservation details containing one of the following: (1) a voucher confirming the reservation and its details (the “Reservation Confirmation” or “Voucher”); or (2) a notice stating that the reservation is still pending with Eldan and is awaiting further confirmation.

Renters completing their reservation by phone shall receive a Reservation Confirmation to the aforementioned email address.

Upon receipt of the Reservation Confirmation by Renter, Eldan shall be obligated to provide Renter with a Vehicle from the relevant selected group, however it does not undertake to provide Renter with a specific model of Vehicle within the selected group and it reserves the right to substitute similar models to those reserved.

If after receipt of the Reservation Confirmation, for whatever reason, the Vehicle and/or any extras included as part of the reservation are unavailable, Eldan will offer Renter an alternative Vehicle and/or extra equivalent to those reserved by the Renter (if available). If Renter chooses not to rent the alternative Vehicle and/or extra, the reservation will be cancelled and Eldan will return to the Renter the full payment made by Renter without any cancellation fee. It is hereby clarified that in such case, the only remedy available to Renter will be the refund of such payment and Renter shall not be entitled to, and hereby irrevocably waives, any other claims for damages, losses, costs, etc. including direct or indirect damages.

If at the applicable time Elden doesn't have an available Vehicle from the relevant group selected by the Renter, Eldan may upgrade the Vehicle to a higher-class Vehicle group. If such upgrade is made and during the rental period the Vehicle from the reserved Vehicle group will become available, the upgraded Vehicle will be replaced with a Vehicle from the reserved Vehicle group and the Renter will cooperate fully with Eldan for this purpose. If the Renter will not cooperate with Eldan regarding the above matter, Eldan shall be entitled to charge the Renter rental payments adjusted to the upgraded Vehicle group, to be effective as of the date of the notice to the Renter in which the Renter was required to come to the Eldan branch to conduct the replacement of the vehicles.

The Vehicle images that appear on the website for each Vehicle group are and shall be for illustration purposes only.

It is hereby clarified that a reservation that has not been confirmed by receipt of a Reservation Confirmation shall not bind Eldan in any way whatsoever.

Notwithstanding the aforesaid, if the Renter reserves an electric Vehicle, and up to 24 hours prior to the pick-up date Eldan discovers that no electric Vehicle of such model or similar is available, Eldan shall be entitled to offer the Renter a non-electric Vehicle, and if the Renter does not wish to pursue such alternative, to cancel the reservation. If the Renter wishes to go through with the rental using the alternative model that was offered to him, the relevant rental payment will be equal to the lower of the rental payment for the reserved electric Vehicle or the rental payment for the alternative non-electric Vehicle offered to the Renter.

During the reservation process, Renter will be presented with several payment options: (a) E-Save/ Non-refundable rate – full payment in advance via the website or through Eldan's call center. It is hereby clarified that with this option the Renter will be charged even if he failed to arrive to pick-up the Vehicle (this option will be the default option); (b) E-Flex/ Flexible rate - partial payment via the website or through Eldan's call center with the remaining amount paid at the rental counter upon pick-up of the Vehicle; or (c) E-Free/ Free Cancellation – the Renter will enter the credit card details upon making the reservation without being charged with the full amount paid at the rental counter upon pick-up of the Vehicle. In some cases, at Eldan’s sole discretion, full payment upon making the reservation for the Vehicle will not be possible, and Renter will be required to pay for the reservation either partially or in full at the rental counter upon pick-up of the Vehicle. Please note that the estimated cost of the rental may vary depending on the payment choice selected by the Renter. Any payment made in connection with the aforesaid will be possible only by using a valid credit card that can be cleared by one of the credit card companies operating in Israel and will be subject to the approval of the credit card company. Eldan will not honor any other means of payment including cash.

The Renter must pick up the Vehicle at the scheduled pick-up hour and no later than two hours from such time as long as such two hours are within the branch’s operating hours, otherwise, Eldan will not be obligated to hold the Vehicle for the Renter. It is clarified that during the summer, Jewish holidays and Christmas period the Renter must pick up the Vehicle at the scheduled pick-up hour and no later than one hour from such time as long as such hours is within the branch’s operating hours, otherwise, Eldan will not be obligated to hold the Vehicle for the Renter.

Upon pick-up of the Vehicle, the Renter must present a valid driver’s license, passport and a valid credit card under his/her name which must be the same credit card used to make the reservation. Subject to the approval of the credit card company, such credit card shall serve as security for any payment owed by the Renter to Eldan in accordance with the Standard Agreement, up to the amount communicated to the Renter at pick-up which will reflect the rental cost plus an amount of up to NIS3,500 (the “Security”) and this Security will be renewed from time to time. Renter must ensure his credit card has a sufficient credit limit to provide such Security. It is hereby clarified that in order to implement the reservation, the credit card presented to Eldan must be that of the person driving the Vehicle.

It is hereby clarified that payments for the rental will not cover charges related to the rental in accordance with the Standard Agreement (such as deductibles (if applicable), charges for damages, traffic and parking violation charges, use of toll roads or fast lanes, fuel payments, kilometer surcharge payment, service/handling fees, etc.)

Any amount which is not paid in full and/or on time, shall bear linkage differences and default interest at such rate applicable from time to time at Bank Leumi Le’Israel Ltd. with respect to debit accounts, to be calculated from the due date for such payment until the date of actual payment. In addition, Renter shall be charged by Eldan for collection expenses, including legal expenses and attorney fees, as may be incurred by Eldan.

Airport Service Fee

An airport Service fee will be charged in the event of a pick-up or drop-off at the Ben-Gurion Airport or the Eldan branch servicing the airport, in case the branch in the airport is inactive.

VAT

The amounts detailed in these Terms of Rental include VAT. It is clarified that any payments made in connection with the rental by Israeli citizens / Israeli passport holders are subject to VAT at the applicable rate under law from time to time, unless expressly stated otherwise in these Terms of Rental or the Standard Agreement. Tourists holding B2, B3 or B4 visas are VAT exempt.

Late Returns

Any delay in returning the Vehicle will be charged in accordance with the terms set out in Section 4.5 of the Full Rental Terms.

Fuel/ Electricity

Fuel and electricity are not included in the rental rates.

If the Vehicle is returned with a fuel tank in which the quantity of fuel is less than the quantity the Renter received, the Renter shall be charged for such missing fuel according to the price of fuel with full servicing, as set out in the Commodities and Services Control Order (Maximum Prices at Fuel Stations), 5762-2002 plus a payment in respect of each liter of missing fuel at the rate set out in the Standard Agreement.

In the case of an electric vehicle, the Renter is obligated to return the electric Vehicle with the battery charged to at least 25% of its maximum charging capacity, otherwise the Renter will be charged NIS50 (including VAT).

Km

Rentals for a duration of 1-2 days include an amount equal to 150 kilometers per day. Rentals for a duration of 3-29 days include unlimited kilometers. Rentals for a duration exceeding 29 days include 100 kilometers per each day of rental. For the avoidance of doubt if the product of the daily rental cost and the aggregate rental days shall exceed Eldan’s monthly rental rate for said Vehicle allowing the Renter to benefit from such monthly rate then the Renter shall be deemed to have rented the Vehicle for a period exceeding 29 days and the kilometer quota shall be adjusted accordingly. Should the total rental exceed the kilometer quota set out in the Standard Agreement (based on the applicable rental period), the Renter shall be charged with a kilometer surcharge payment for each kilometer above said quota in the amount set out in the Standard Agreement. Notwithstanding the aforesaid, if Eldan will provide the Renter a Vehicle under more favorable conditions, such favorable conditions will apply to the engagement between the parties.

Safety

It is a statutory requirement that the driver and passengers wear seat belts while driving. Infants, toddlers and children must be seated in car seats suitable to their individual size, weight and age.

Children under 14 years of age should always be seated in the rear seats.

Breakdowns

In the event of a breakdown, please contact our call center which is open 24 hours a day, 7 days a week at *3003.

Traffic Violations

The Renter is liable for any fine or report received from a competent authority at the time the Vehicle was used by the Renter, including but not limited to parking fines, traffic violations and/or towing during the rental period. Any such fine or report received by Eldan shall be assigned automatically to the Renter in accordance with the Renter’s details in its possession and Eldan shall charge the Renter an additional handling fee for handling the assignment of each fine as set out in the Standard Agreement for each fine.

Cancellation Policy

Renter may cancel the reservation in the following manner: (a) via the website; (b) by sending a request by email to: cancelorder@eldan.co.il; (c) by contacting Eldan by telephone at *3003; or (d) by facsimile at 972-077-7613889. Cancellation notice is required to be made within the following timeframes:

(a) E-Save/ Non-refundable rate – within 14 days of making the reservation and at least 2 working days before the pick-up date;

(b) E-Flex/ Flexible rate – within 14 days of making the reservation and at least 2 working days before the pick-up date;

Eldan shall send the Renter a confirmation of such cancellation up to 2 working days after receiving the Renter’s cancellation notice. In case of cancellation within the above timeframe mentioned in subsection (a) or subsection (b), Eldan shall be entitled to charge the Renter the lowest of 5% of the cost of rental or NIS 100 as a cancellation fee, using the credit card provided by the Renter at the time of reservation.

In case of cancellation within the above timeframe mentioned in subsection (c) Eldan will not charge the Renter any additional fee.

Notwithstanding the aforesaid Eldan shall be entitled to charge the Renter a cancellation fee of up to the daily rental cost in each of the following cases: (a) in case of a cancellation not within the above timeframes; or (b) in case Renter does not arrive to pick up the Vehicle at the required pick-up time (“No Show”); or (c) in case Renter arrives to pick up the Vehicle but does not meet the pre-conditions required to rent the Vehicle under these terms or the Full Rental Terms (for example if the Renter does not have sufficient credit in his/her Credit Card or does not present a valid driver’s license). A cancellation fee may be charged for each reserved Vehicle subject to applicable law.

A Renter which wishes to update the details of his/her/its reservation (including rental dates, type of vehicle, extras, pick up/return location, coverage for damages, etc.) may do through the website or by telephone at *3003. If the Renter wishes to cancel the reservation (for example in the case the Renter does not agree to the updated rental cost if updating the reservation affected such cost), Renter may do so in accordance with the cancellation policy set out above and may be charged with a cancellation fee, depending on the timing of cancellation as provided above. In any case, for the avoidance of any doubt, an update to the reservation will be effective only upon receipt of an updated Reservation Confirmation from Eldan.

It is clarified that any update to any of the reservation details (including dates, vehicle type, pick-up/return location, extras, coverage for damages, etc.), may change the total estimated cost of the rental, and Eldan will not be bound by the pricing displayed in the initial reservation process, including prices of extras, coverage for damages, etc.

Drop off Fee

At the end of the rental period, the Renter will return the Vehicle to the Eldan branch from which it was picked up, or to a different Eldan branch in coordination with Eldan, otherwise the Renter will be charged with a handling fee for having to transport the Vehicle, in accordance with Eldan's price list. Notwithstanding the foregoing, a Renter renting a Vehicle of any category for a period not longer than 2 days, and the Renter picked up the Vehicle in Eilat and returned it to another Eldan branch (not in Eilat) or returned the Vehicle in Eilat after picking up the Vehicle in a different Eldan branch (not in Eilat) shall be charged with an additional drop off fee of NIS 819/US$222/Euro199/₤144.

Rates policy

The estimated cost for the rental of the Vehicle is the cost indicated on the website at the time of reservation which will not constitute the final cost to the Renter but only an estimated cost based on the rental details at the time of reservation and may be subject to any change, amendment and addition to the rental details, including, without limitation, shortening or extending the rental period, changing the place and date of pick-up/return of the Vehicle, the purchase of any extras, etc. Without derogating from the foregoing, until the reservation is made, Eldan reserves its right to change, at any time, the prices of the rental, without being required to provide any prior notice.

It is hereby clarified that the minimal rental period is 24 hours so that any Renter that rents a Vehicle for a period of less than 24 hours shall in any event be charged for a 24-hour period. In addition, Eldan may determine, at its sole discretion, that a certain rental will be subject to a longer minimal rental period.

Toll Roads/Fast Lanes

The prices do not include payment for usage of toll roads/fast lanes. Payment for driving on a toll road/fast lane will be charged according to the rates published by the toll road/fast lane operator for non-subscribing customers plus an additional handling fee which appears in the price list displayed at Eldan’s branches.

To the best of Eldan’s knowledge Renters are able to directly contract with the toll road/fast lane operator, subject to the terms and conditions of the toll road/fast lane’s operating company and to the contractual terms of such company. This should not be viewed as a recommendation to directly contract with the operating company. Should the Renter violate his/her obligations to the toll road/fast lane operating company, the Renter will bear all charges, fines and legal expenses which Eldan may be required to pay the toll road/fast lane operator, plus handling fees as set out in the Standard Agreement.

Ben Gurion Airport Branch

The Ben Gurion Airport branch operates all days of the week. Pick up operating hours are between 7:00 – 23:00. Rental of Cars outside operating hours will not be possible. Cars may be returned 24 hours a day, however return of Cars outside working hours may be charged with an additional payment.

Rentals in Eldan’s branch in Ben Gurion Airport are intended only for travelers who landed in the airport within 24 hours prior to the rental of the Vehicle holding an entry permit or copy of a flight ticket evidencing the same. We recommend that customers that do not comply with this requirement make use of our other rental branches.

General

Eldan reserves the right to refuse Vehicle rental and/or any other service to any Renter who does not comply with all the above terms or the terms of the Standard Agreement.

In these Terms of Rental, words in the masculine shall be interpreted as also including the feminine and words in the singular shall be interpreted as also including the plural and vice versa, all according to the substance and the context.

In any contradiction between the terms set out herein or the terms set out in the Standard Agreement, the terms set out in the Standard Agreement shall override.

Any amounts set out in any currency in the Standard Agreement shall be converted to the currency of the actual payment, whether by the request of the Renter or otherwise, based on the last representative exchange rate published by the Bank of Israel and known at the time of delivery of the Vehicle.
